1. Agreement to Terms

By downloading, installing, or using the Good Air Day mobile application (the "App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the App.

2. About Good Air Day

The App provides recommendations about when to open your windows based on outdoor weather, air quality, and pollen data, personalized to your preferences. The App is operated by Kaiser Murdock and Associates LLC ("we," "us," or "our"). The App is currently available only in the United States.

3. Not Medical or Professional Advice

The App is a general wellness tool. It is not a medical device, does not provide medical advice, diagnosis, or treatment, and should not be used as a substitute for professional medical judgment. If you have health conditions such as asthma or severe allergies, consult a qualified healthcare provider about outdoor air exposure.

The App relies on third-party weather and environmental data, which may be inaccurate or delayed. We do not guarantee the accuracy of any information provided.

4. Your Account

You may need to create an account to use the App. You are responsible for:

Providing accurate information at sign-up
Maintaining the security of your account credentials
All activity that occurs under your account

You must be at least 13 years old to use the App.

5. Acceptable Use

You agree not to:

Use the App for any illegal purpose
Attempt to gain unauthorized access to our systems
Interfere with or disrupt the App or associated services
Reverse engineer, decompile, or attempt to extract source code
Use automated systems to access the App

6. Intellectual Property

All content in the App, including the name "Good Air Day," logos, and software, is owned by Kaiser Murdock and Associates LLC or its licensors and is protected by copyright, trademark, and other intellectual property laws.

Third-party data (weather, air quality, pollen) is licensed to us by our data providers and remains their property.

7. Modifications to the App

We may modify, suspend, or discontinue any part of the App at any time, with or without notice. We are not liable for any modification or discontinuation.

8. Termination

We may suspend or terminate your account if you violate these Terms. You may delete your account at any time through the App's settings.

9. Disclaimers

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT DEFECTS WILL BE CORRECTED.

10. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, KAISER MURDOCK AND ASSOCIATES LLC, ITS OFFICERS, EMPLOYEES, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE APP.

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING FROM THESE TERMS OR THE APP SHALL NOT EXCEED ONE HUNDRED DOLLARS ($100).

11. Indemnification

You agree to indemnify and hold harmless Kaiser Murdock and Associates LLC from any claims, damages, or expenses arising from your use of the App, your violation of these Terms, or your infringement of any rights of another party.

12. Governing Law

These Terms are governed by the laws of the State of California, without regard to conflict of law provisions. Any dispute shall be resolved in the state or federal courts located in San Francisco County, California.

13. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will notify you within the App or by email. Continued use of the App after changes constitutes acceptance.
